High court clarifies individuals barred from Chadema political activities

THE High Court in Dar es Salaam has issued a formal clarification listing the 10 individuals and groups prohibited from engaging in any political activities within the opposition party Chadema, as per a court injunction.

THE High Court in Dar es Salaam has issued a formal clarification listing the 10 individuals and groups prohibited from engaging in any political activities within the opposition party Chadema, as per a court injunction.

The injunction stems from Civil Case No. 8960/2025, filed by former Chadema Vice Chairman (Zanzibar) Said Issa Mohamed, along with Ahmed Rashid Khamis and Maulida Anna Komu.

The clarification was made public yesterday today by Advocates Gizo Simfukwe and Shabaan Marijani. They addressed what they described as “misleading information” circulating regarding the scope of the court’s injunction, initially issued on June 10, 2025. 

According to the advocates, some individuals had distanced themselves from the order, claiming it did not apply to them.

"Due to this misinformation, we, as legal representatives of the petitioners, wrote to the Registrar of the High Court, Dar es Salaam Sub-Registry, seeking official clarification on the parties affected by the injunction," said Advocate Simfukwe.

He confirmed that a response was received from the Registrar on July 14, 2025, and a copy was shared with the respondents in the case. The clarification confirmed that the injunction applies to a broader group than previously claimed, not just the Board of Trustees and Secretary-General.

“This is the legal position provided by the Registrar: all the individuals listed below are restrained from participating in any political activities until the main case is heard and determined,” Simfukwe stated.

The affected parties are the Board of Trustees, Chairperson,Vice Chairperson  (Mainland),Vice Chairperson (Zanzibar) Acting Secretary-General, Deputy Secretary-General (Mainland),Deputy Secretary-General (Zanzibar).

Also any employee, agent, or individual acting on behalf of the party, including those given instructions or representing the party in political activities at any level across the United Republic of Tanzania (Mainland and Zanzibar)

Simfukwe warned that violation of the court’s injunction constitutes contempt of court—a criminal offense—and may also carry civil legal consequences.

“When the court issues a binding order, no one has the liberty to ignore it by claiming they are not affected. Doing so amounts to breaking the law. This clarification is meant to counter ongoing misinformation,” he added.

Advocate Marijani further emphasized that the restrained individuals are also prohibited from speaking to the media about any party matters.

The injunction was granted by Judge Hamidu Mwanga under Miscellaneous Civil Application No. 8960/2025. The main case, Civil Case No. 8323/2025, remains pending before the court.
